1.Purpose

Bunker Building Supplies (“Bunker”, “we”, “us”), trading at thebunker.net.au and operated by Upton Group, does not advertise, promote, or drive traffic to this website by sending unsolicited commercial electronic messages, and does not authorise, engage, or knowingly benefit from any other person or organisation doing so on our behalf.

This policy sets out that commitment, what it covers, and how to report a suspected breach.

2.Scope

This policy applies to:

  • Bunker and its employees;
  • contractors, agencies, and marketing partners engaged to promote Bunker; and
  • affiliates, resellers, and referral partners who earn a benefit (commission, credit, or otherwise) from traffic or sales attributed to thebunker.net.au.

It covers commercial electronic messages of every kind — email, SMS and MMS text messages, and instant or social messaging platforms — sent for the purpose of advertising, promoting, or offering goods, services, or discounts related to thebunker.net.au.

3.What we mean by “unsolicited”

We follow the definitions used in the Spam Act 2003 (Cth), Australia’s legislation covering commercial electronic messages, and the guidance of its regulator, the Australian Communications and Media Authority (ACMA).

Commercial electronic messageAny email, SMS, MMS, or instant message that offers, advertises, or promotes goods, services, land, business, or investment opportunities — including a message that promotes Bunker or thebunker.net.au.
ConsentExpress consent given directly by the recipient, or consent reasonably inferred from an existing business or personal relationship and the person’s conduct.
UnsolicitedSent without that consent — including messages built from purchased, scraped, harvested, or address-generated lists.

A message that meets the Spam Act’s three core requirements — consent, clear identification of the sender, and a working unsubscribe facility that is honoured within five business days — is not something this policy is directed against. Our concern, and the Act’s, is with messages that skip one or more of those requirements.

4.Our own marketing practice

  • We contact people who have opted in — customers, account holders, trade account contacts, and newsletter subscribers who have given consent.
  • We do not buy, rent, harvest, or scrape contact lists for marketing purposes.
  • Every marketing message from us clearly identifies Bunker Building Supplies / Upton Group and provides a functioning, no-cost way to opt out.
  • Opt-out requests are honoured within five business days, in line with the Spam Act.

5.Third parties acting on our behalf

Anyone advertising thebunker.net.au — an affiliate, referral partner, freelance marketer, or agency — must market only to recipients who have given consent, and must not use spam of any kind to do so. This is a condition of any affiliate, referral, or marketing arrangement with Bunker, whether or not it is separately stated in a contract.

A partner found to be using unsolicited electronic messages to promote thebunker.net.au will have their arrangement suspended pending review and, if confirmed, terminated. Bunker will not pay out commissions or credits earned through traffic generated by spam, and reserves the right to report serious or repeated breaches to ACMA.

6.Reporting suspected spam advertising our site

If you receive an unsolicited message advertising thebunker.net.au that you believe breaches this policy, please forward it — with full headers where possible — to us using the details below. We investigate every report and act on confirmed breaches under Section 5.

You can also report spam directly to ACMA at acma.gov.au/report-spam, or forward unwanted SMS to 0429 999 888 and email to report@spam.acma.gov.au.

7.Policy review

We review this policy periodically and whenever the Spam Act, its regulations, or ACMA guidance change. The “last reviewed” date above reflects the most recent review.
